Welcome to Cozy and Crushing It.

We know Terms & Conditions aren't exactly fireside reading material. Still, they matter. These terms explain what you can expect from us, what we ask from you, and what happens when you purchase or use something from the Cozy and Crushing It world.

We've tried to keep them clear, fair and human.

By purchasing a product from Cozy and Crushing It, you agree to these Terms & Conditions.

1. Who We Are

Cozy and Crushing It is a digital brand operated by a sole proprietorship established in the Netherlands.

Throughout these Terms, “Cozy and Crushing It”, “we”, “us” and “our” refer to the business operating Cozy and Crushing It.

2. When These Terms Apply

These Terms apply when you purchase our digital products or otherwise enter into an agreement with Cozy and Crushing It.

Our website may also contain links to products sold by other companies. Those purchases are different — see Affiliate Links & Third-Party Products below.

Before completing a Cozy and Crushing It purchase, you will have an opportunity to review these Terms.

By checking the required box at checkout and completing your order, you confirm that you have read and agree to them.

3. Our Digital Products

Cozy and Crushing It creates and sells digital products which may include:

eBooks;

workbooks;

printables;

templates;

scripts;

guides;

digital resources; and

other downloadable or digitally delivered materials.

The exact contents of your purchase will be described on the relevant product or checkout page.

Unless explicitly stated otherwise, our products are supplied digitally. Nothing is coming through your letterbox.

4. Prices & Payment

The price shown at checkout is the price applicable to your order, subject to any taxes or charges that must legally be added or displayed separately.

Payments may be processed by third-party payment providers such as Stripe.

By submitting payment information, you confirm that you are authorised to use the selected payment method and that the information you provide is accurate.

We do not store your full payment-card details ourselves where these are processed directly by our payment provider.

Any applicable VAT or other taxes will be handled in accordance with the laws and tax rules applicable to the transaction.

5. Digital Delivery

Our instant digital products are designed to be delivered without making you wait for a parcel van.

After successful payment, your product may be:

available immediately on a confirmation or download page;

sent to the email address provided during checkout; or

made available through another digital delivery method described before purchase.

You are responsible for providing a valid email address and for checking your Spam, Junk or Promotions folders if your delivery email doesn't appear.

If your purchase genuinely disappears into the digital wilderness, contact quietlylegendary @ cozyandcrushingit.com and we'll help you get access.

6. Right of Withdrawal & Immediate Digital Delivery

If you are a consumer in the European Union or European Economic Area, you normally have a statutory right of withdrawal for many purchases made online.

Special rules apply to digital content that is not supplied on a physical medium.

When purchasing an instant digital product from us, we may ask you at checkout to expressly:

request and consent to the supply of the digital content beginning immediately, during the statutory withdrawal period; and

acknowledge that once supply of the digital content begins, you lose your statutory right of withdrawal for that digital content.

You will not be able to complete an instant digital purchase requiring this consent unless you provide the required acknowledgement.

Once you have expressly consented, acknowledged the loss of your withdrawal right and we have begun supplying the digital content, you can no longer cancel the purchase under the statutory cooling-off period simply because you have changed your mind.

We will provide the legally required confirmation of your purchase and consent.

Nothing in this section limits any mandatory consumer rights that cannot legally be waived.

7. Digital Product Refund Policy

Because our downloadable digital products can be accessed or delivered immediately, we do not offer change-of-mind refunds after your statutory withdrawal right has validly ended as described above.

An eBook can't meaningfully be put back on the shelf. A printable can't be un-downloaded. You get the idea.

However, this does not mean “no refunds under any circumstances.”

You retain any rights you have under applicable consumer law if, for example:

the digital product is defective;

you don't receive what you purchased;

the product is materially different from its description; or

applicable law otherwise entitles you to a remedy.

Where legally required, we will repair or correct the problem, provide replacement access, reduce the price, refund the purchase or provide another appropriate remedy.

We'd much rather solve the problem than hide behind the fine print.

8. Personal Use & Your Licence

Unless the relevant product expressly says otherwise, purchasing a Cozy and Crushing It digital product gives you a personal, non-exclusive, non-transferable licence to use that product for your own personal or internal business use.

You are purchasing permission to use the product.

You are not purchasing the copyright or ownership of the underlying content.

Unless we have expressly given you written permission, you may not:

resell our digital products;

redistribute or publicly upload them;

share purchased files with others;

reproduce them for resale;

repackage them as your own product;

give them away as a freebie, lead magnet or bonus;

use substantial parts of them to create a competing commercial product; or

remove copyright, attribution or other proprietary notices.

Buying one copy does not magically turn it into a team subscription. 😉

If a particular product includes commercial, client-use, resale or other extended rights, those rights will be clearly stated with that product.

9. Intellectual Property & The Cozy World

The Cozy and Crushing It website, original written content, products, designs, illustrations, branding, characters, stories and other original creative materials are owned by or licensed to Cozy and Crushing It to the extent protected under applicable intellectual-property law.

That includes the creative world we've built around Nyra.

Nyra is a fictional, AI-created brand character developed for Cozy and Crushing It. Her images and environments may be created or enhanced using artificial intelligence and other digital creative tools.

To the extent protected by applicable intellectual-property law, our original Nyra artwork, character designs, written characterisation, stories, branding and related creative materials belong to or are licensed to Cozy and Crushing It.

You may enjoy Nyra, talk about her and share links to our publicly available content.

You may not, without our prior written permission, use Nyra, her images, identity or other Cozy and Crushing It creative assets:

to advertise your own products or services;

in your own commercial marketing;

on merchandise or products for sale;

to create derivative promotional materials;

in a way that suggests an endorsement, sponsorship or collaboration with Cozy and Crushing It; or

as part of another commercial brand or character.

Nyra may be AI-created, but she isn't public property. Please leave our girl in her own Cozy World. 🤍

10. Educational Content — No Guaranteed Results

Our products and content are created to provide information, ideas, tools and education.

We don't guarantee a particular personal, professional, business or financial result from using them.

A brilliant script can help you prepare for a conversation. It cannot control the person sitting on the other side of the table.

Your results will depend on your circumstances, decisions, implementation and many factors outside our control.

Nothing in our products or website constitutes personalised legal, tax, financial, medical or other regulated professional advice.

Where appropriate, seek advice from a qualified professional for your individual situation.

11. Affiliate Links & Third-Party Products

Sometimes we recommend products, software, books, platforms or services created and sold by other companies.

Some of these recommendations use affiliate links. If you purchase through one of those links, Cozy and Crushing It may receive a commission, generally without increasing the price you pay.

When the product is sold by a third party, Cozy and Crushing It is not the seller.

Your purchase agreement is between you and that third-party seller.

That means the third party is responsible for matters relating to its own:

product or service;

pricing;

billing;

subscriptions;

delivery;

customer support;

cancellations;

refunds;

warranties;

privacy practices; and

terms and conditions.

We cannot guarantee that a third-party product will remain unchanged forever. Features, prices, availability, policies and businesses themselves can change.

Please review the seller's current information and terms before purchasing.

12. Third-Party Platforms

We use third-party technology to run parts of Cozy and Crushing It.

That may include payment processors, website and funnel platforms, email providers, automation tools and digital-delivery services.

While we choose our tools with care, we cannot promise that every external service will be available every second of every day.

Where a problem with one of our providers affects delivery of something you purchased from us, contact us and we will take reasonable steps to make sure you receive what you are entitled to.

Our use of a third-party platform does not mean that platform sponsors, endorses or owns Cozy and Crushing It.

13. Acceptable Use

Please use our website and products lawfully and reasonably.

You must not knowingly:

interfere with the operation or security of our website;

attempt to gain unauthorised access to our systems;

use our products or website for unlawful purposes;

distribute malicious software;

impersonate Cozy and Crushing It or misrepresent an association with us;

infringe our intellectual-property rights or those of another person; or

use our materials in a way prohibited by these Terms.

Basically: enjoy the Cozy World. Don't set fire to the furniture.

14. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

To the extent permitted by applicable law, Cozy and Crushing It is not liable for indirect or consequential losses arising solely from your use of general educational information, your business decisions based on that information, or third-party products and services that we do not sell.

You remain responsible for how you choose to apply the information, tools and resources we provide.

Any limitation of liability in these Terms is subject to mandatory consumer law and does not affect rights or remedies that cannot legally be excluded.

15. Privacy & Cookies

When you purchase from us or use our website, we process personal information.

Our Privacy Policy explains what information we collect, why we process it, which types of service providers may receive it, how long we retain it and what privacy rights you may have.

Our Cookie Policy explains how cookies and similar technologies are used on the website.

You do not surrender your privacy rights simply by agreeing to these Terms.

Where the law requires separate consent — for example for certain marketing or non-essential tracking — we will request that separately.

16. Complaints & Problems

Include enough information for us to identify your order and understand what happened.

We will make reasonable efforts to investigate and respond within an appropriate period.

Your statutory rights and any legally available dispute-resolution or court procedures remain unaffected.

17. Governing Law & International Customers

Cozy and Crushing It is operated by a business established in the Netherlands.

These Terms and our agreements are governed by Dutch law to the extent that the parties are legally permitted to make that choice.

However, if you are a consumer living in another country, this choice of law does not deprive you of mandatory consumer protections that apply to you under the law of your country and that cannot legally be excluded by contract.

Nothing in these Terms is intended to restrict mandatory rights concerning jurisdiction, dispute resolution or access to courts.

18. Changes to These Terms

We may update these Terms when our products, business, technology or legal obligations change.

Changes will apply prospectively unless applicable law requires otherwise.

The version that applied when you made a purchase will generally continue to govern that purchase, except where a change is required by law or otherwise lawfully applies.

The latest version will always be available on our website with its most recent update date.

19. Severability

If a particular provision of these Terms is found to be invalid or unenforceable, that does not automatically make the rest of the Terms disappear in a puff of legal smoke.

The remaining provisions will continue to apply to the extent permitted by law.
